These Terms & Conditions ("Terms") govern your use of NightSkyMemory (nightskymemory.com) and any purchase you make. NightSkyMemory is operated by Custom Output, a sole proprietorship based in Rhode Island, USA ("we," "us," "our"). By using the site or placing an order, you agree to these Terms.

What we sell

We create personalized digital star maps depicting the night sky for a date, time, and place you choose, along with a personalized digital card. We also offer optional physical prints produced and shipped by a third-party print-on-demand partner.

Digital: a personalized star map and digital card delivered electronically (by email and/or text).
Print: everything in Digital, plus a physical print produced and shipped by our fulfillment partner.

Accuracy of the star map

We calculate the position of the stars and the true phase of the moon for the date, time, and location you provide. The moon and decorative elements are rendered in a stylized, artistic manner and are positioned for visual effect; the star map is an artistic keepsake, not a scientific or navigational instrument. You are responsible for entering the correct date, time, and place — we render based on the details you submit.

Orders and pricing

Prices are shown at checkout and may change at any time before purchase.
Payment is processed securely by Stripe. By ordering, you authorize the charge for your selected option.
We may decline or cancel an order (with a refund) in cases of suspected fraud, error, or inability to fulfill.

Delivery

Digital orders

Digital star maps and cards are delivered electronically, typically within minutes of purchase, to the email (and/or phone number) you provide. It is your responsibility to provide an accurate email/number and to check spam folders. [State your delivery commitment, e.g. "delivered instantly / within X minutes."]

Print orders

Prints are produced and shipped by our print-on-demand partner. Estimated production and shipping times are shown at checkout and are estimates, not guarantees. Refunds and cancellations

Digital orders

Because digital products are personalized and delivered immediately, all sales of digital items are final once the file has been delivered, except where required by law. Print orders

Because prints are made to order (personalized), we cannot accept returns for change of mind. If your print arrives damaged, defective, or incorrect due to our or our partner's error, contact us within [X days] of delivery with a photo, and we will arrange a replacement or refund. Your content and personalization

You are responsible for the names, messages, and details you submit. You agree not to submit content that is unlawful, infringing, hateful, or otherwise objectionable. We may refuse to produce any order containing such content. You grant us the limited right to use the details you provide solely to create and deliver your order.

Intellectual property

The website, designs, software, the NightSkyMemory name and logo, and all related materials are owned by Custom Output and protected by law. Your purchase grants you a personal, non-commercial license to use your finished star map for personal, gifting, and household purposes. You may not resell or commercially redistribute our designs or templates.

Disclaimers

The service is provided "as is" and "as available," without warranties of any kind, express or implied, to the fullest extent permitted by law. We do not warrant that the site will be uninterrupted or error-free.

Limitation of liability

To the fullest extent permitted by law, Custom Output's total liability for any claim arising from your use of the service or a purchase will not exceed the amount you paid for the order giving rise to the claim. We are not liable for indirect, incidental, or consequential damages. [Have a lawyer confirm this clause is enforceable in your jurisdiction.]

Governing law
